El Tribunal Supremo ha revocado el tercer grado que la Generalitat concedi\u00f3 a los l\u00edderes independentistas condenados por sedici\u00f3n y que estaba suspendido temporalmente en casi todos los casos a la espera de la decisi\u00f3n del alto tribunal. Los magistrados que juzgaron el proc\u00e9s consideran \u201cprematuro\u201d que los presos disfruten ya del tercer grado y destacan que es preciso que transcurra un periodo de tiempo mayor para evaluar la evoluci\u00f3n del interno y el tratamiento penitenciario, especialmente cuando se trata de condenas elevadas (de 9 a 13 a\u00f1os de c\u00e1rcel) de las que ninguno ha cumplido la mitad, y la mayor\u00eda ni siquiera una cuarta parte. El tribunal ha anulado tambi\u00e9n la otra v\u00eda abierta por la Generalitat para flexibilizar el cumplimiento de la pena de los nueve presos: la aplicaci\u00f3n del art\u00edculo 100.2 del reglamento penitenciario, que les permit\u00eda salir de prisi\u00f3n a diario para trabajar, hacer voluntariado o cuidar de familiares. En sus resoluciones, el tribunal ve un intento de la Generalitat de dar a los l\u00edderes independentistas un \u201ctratamiento penitenciario privilegiado\u201d.
